A LEGAL action by the Sunday Tribunereceiver over publication by the Irish Mail on Sundayof an alleged fake copy of the Tribune shortly after it went into receivership has been settled at the Commercial Court.

The settlement was announced yesterday to Mr Justice Peter Kelly who agreed to make orders striking out the proceedings. No details of the settlement were disclosed.

The action by receiver Jim Luby was brought over publication by the Irish Mail on Sundayon February 6th last of an alleged fake copy of the Tribunejust after it went into receivership. Associated Newspapers, publisher of the Mail, had denied wrongdoing.

The receiver alleged the Mailpublished 26,000 issues of an edition of the paper with a "wraparound" cover carrying a Tribune-style logo on that date constituting "passing off", injurious falsehood and interference with the economic interests of the Tribune. Some 10,000 copies were sold.
