Cavan County Council had faced a dilemma over its inadequate sewage treatment plant at Ballyjamesduff because Department of the Environment funds were not available to replace it, the Supreme Court was told yesterday.

The council had been convicted by Cavan District Court of polluting a river. The judge, however, had referred the case to the High Court as he believed the council had done its best in the matter. The council had appealed the High Court's findings. Yesterday, the Supreme Court reserved judgment. Mr John Gallagher SC, for the council, said there would be a new treatment plant within the next year.
