The rape trial of a 32 year old Dublin man failed to proceed at the Central Criminal Court yesterday because a Garda witness is on peacekeeping duties in Bosnia.

The accused man was remanded on continuing bail by Mr Justice Flood who discharged the jury and adjourned the case to Thursday to fix a new trial date.

Earlier, the jury was sworn in when the man pleaded not guilty to raping and sexually assaulting a 20 year old woman in Dublin on October 2nd, 1994.

Defence counsel Mr Barry White SC said the witness was essential as he had been involved in the detention of his client in a Garda station during the rape investigation.

Mr Michael Durack SC, prosecuting, said inquiries were made to see if the witness could be flown home.
