A man who broke his back when he dived into a council owned swimming pool won a 10 year compensation battle yesterday. The ruling in the Appeal Court in Belfast means that Mr Martin Maguire (33), Abbey Drive, Church Road, Enniskillen, Co Fermanagh, is now in line for a large award.

Mr Maguire has been confined to a wheelchair since 1985 when he slipped as he dived into the shallow end of the swimming pool at the Lakeland Forum, Enniskillen. Three years ago he lost a compensation claim against Fermanagh District Council after a judge held that he had failed to prove negligence.
