Judge Dan Shields, at Ballina District Court, yesterday refused informations in a private prosecution arising out of a fatal accident in Ballina, Co Mayo, on December 26th, 1994.
The prosecution was brought by Mrs Yvonne Kevany, Church Road, Ballina, Co Mayo, against Mr Rony Sieu, a Malaysian with an address at Wesley Court, Ballina, for alleged dangerous driving, causing the death of or serious bodily injury to her brother, Brian Ahern.
State charges had already been withdrawn in the District Court when evidence was not tendered. Yesterday Judge Shields held that the forensic evidence was so strong it ruled out any possibility of any impact between the accused man's vehicle and Mr Ahern.
