The prosecution against an English man following the death of another man during a fight in a Dublin hotel has been dismissed. Mr Gary Benson (34), of Weybridge, Surrey, was charged with causing violence with the deceased man, Mr Francis Tomilson, and his brother, Mr Anthony Tomilson, at Jury's Inn, North Wall, on April 19th last year.

Judge Gerard Haughton ruled there was no evidence that the violence used was "unlawful".
