Horseplay injury dismissal results in €32,000 award

A worker who was injured during horseplay with fellow employees was awarded €32,000 for unfair dismissal.

A worker who was injured during horseplay with fellow employees was awarded €32,000 for unfair dismissal.

Keith Tims, Ballyfermot Road, Dublin, took a case for unfair dismissal against Architectural Aluminium Limited, Oak Road, Western Business Park, Dublin, which manufactures and installs facades.

Mr Tims, a manufacturing fabricator, had been involved in banter and horseplay with colleagues, but told the manager he fell over a ramp after he caught his boot on it.

The Employment Appeals Tribunal, having viewed CCTV footage, felt Mr Tims had not deliberately intended to mislead.

It appeared from the footage there was horseplay between Mr Tims and colleagues on the date in question. The tribunal found disciplinary procedures used in the matter were flawed. It found Mr Tims was unfairly dismissed and awarded him €32,000.
