An appeals court in southwestern France agreed today to handover a lawyer to Spain who is suspected of acting as a messenger for Basque separatist group Eta, a court official said.

Jose Agudo Mancisidor (34) was arrested in Hendaye in southern France, where he lived, in late October.

He was detained at the time under an arrest warrant issued in Spain.

France has dealt Eta a setback this year with a series of arrests and raids of arms caches. In October, it arrested Aitor Elizaran, one of the top members of the group.

Eta, whose name Euskadi ta Askatasuna means Basque Homeland and Freedom, was founded 50 years ago under Franco's dictatorship.

It has killed more than 800 people in its campaign for an independent Basque Country carved out of northern Spain and southern France.
