The High Court yesterday ordered that a 16 year old who is facing charges of evading paying the proper train fare and of abusing an Iarnrod Eireann inspector be released from St Patrick's Institution in Dublin. On Tuesday, District Judge John Paul McDonnell remanded the youth in custody until tomorrow when he is due to appear in court.

Yesterday's High Court hearing before Mr Justice Moriarty followed an application by the youth's mother for an order requiring the production of her son before the judge and for the court to inquire into his detention.

Mr Justice Moriarty, releasing the youth on his own bail of £50, said the judge's action was a departure from appropriate legal procedures.
