THE HIGH Court has continued an interim injunction grounding two aircraft at Dublin airport pending the hearing of proceedings in which it is alleged a charter company is not operating them in a safe manner.
The planes had been leased by Aer Arann under a charter agreement from White Eagle Aviation (WEA) SA, of Woloska Street, Warsaw, Poland.
Aer Arann claims WEA has breached a contract to operate the aircraft in a safe and effective manner and in accordance with rules governing air travel. The aircraft have been grounded since last Saturday when Aer Arann obtained an interim injunction preventing WEA from removing the aircraft.
Yesterday, Mr Justice Roderick Murphy continued that injunction pending the outcome of proceedings by Aer Arann. The airline has also obtained an injunction restraining WEA from reducing its assets within this jurisdiction below €223,465, the amount Aer Arann says it paid it as a deposit.
An affidavit by Aer Arann's solicitor, Rachel Mulligan, said the airline became aware earlier this month there had been "a number of potentially serious breaches of safety" by WEA.
