THE Belfast Crown Court retrial of the south Armagh men accused of murdering postal worker Mr Frank Kerr failed to start for the third consecutive day because of legal argument.

Lawyers for Mr Declan McComish (28) and Mr Kevin Donegan (39), both from Jonesborough, have argued that their original lawyers and the prosecution at their aborted trial last February should reveal what discussions took place between them and the North's Lord Chief Justice, Sir Brian Hutton.

The trial judge, Mr Justice Kerr, said he wished to reserve his decision on the matter and will make a ruling on Monday. Both Mr McComish and Mr Donegan deny murdering the postal worker shot during the six man armed raid on his Border sorting office on November 10th, 1994.
