The Supreme Court today agreed to hear an appeal by ACC Bank against the High Court’s decision to permit a second application for court protection and the appointment of an examiner to companies in Liam Carroll’s beleaguered Zoe Group.

The court will hear the appeal by the Bank on Friday October 2nd at noon.

Should the bank be unsuccessful in its appeal against the decision by Mr Justice John Cooke, then the Supreme Court will hear an appeal by the Zoe Group companies seeking to overturn the High Court decision not to appoint an examiner in the second application.

The Supreme Court indicated that the Zoe Group’s appeal against the High Court’s reject of the second examiner ship application would be heard as early as possible, most likely in a week or two after the ACC appeal on October 2nd.

The Supreme Court also continued stay on an order by Mr Justice Frank Clarke in the High Court last week on the winding up of two companies at the apex of the Zoe Group, Vantive Holdings and Morston Investments.
